About Us

Our Services

Port Law

Beyond our maritime practice, we advise operators, terminals and agents across the port regulatory landscape, with in-depth knowledge of the Brazilian Ports Act (Law No. 12,815/2013), ANTAQ regulations and the rules of the federal port authorities.

Compliance & Regulation

Qualification and accreditation of port operators before the port authority (CAP), authorization of Private-Use Terminals (TUP) and compliance with ANTAQ regulations.

Administrative Litigation

Defense in enforcement proceedings before ANTAQ, challenges to notices of infraction, negotiation of Conduct Adjustment Agreements (TACs) and administrative appeals against acts of the port authorities.

Leases & Concessions

Review and analysis of port lease agreements, advisory on public tender processes, and contractual renewals and renegotiations with port authorities and the labor management body (OGMO).

Tariff Disputes

Challenges to abusive Terminal Handling Charges (THC) and other port tariffs. Mediation and arbitration in operational disputes among terminals, carriers and logistics operators.

Solutions That Make a Difference

Demurrage & Detention

Specialized practice in container demurrage and detention, with technical laytime analysis and challenges to abusive charges. We defend clients where delays result from holds imposed by inspection authorities — the Federal Revenue Service, ANVISA, VIGIAGRO — or from third-party operational failures.

Laytime analysis · Inspection authorities · Administrative challenge

Maritime Litigation

Defense in lawsuits brought by carriers and terminals, focused on voiding improper charges and negotiating strategic settlements that preserve the client's cash flow and operational continuity.

Carriers · Terminals · Settlement negotiation

Transport Contracts

Analysis and structuring of chartering and maritime transport clauses to mitigate risks and prevent extraordinary costs, with preventive review before any contractual commitment is undertaken.

Chartering · Bill of Lading · Risk management

Founding Partner

With over 25 years of experience in foreign trade and law, Dr. Marcelino André Stein has built an unusual career path: before defending those who move cargo, he spent years on the other side of the counter. He was Country Manager for Maersk Logistics in Brazil and an executive at major international freight forwarders, where he learned firsthand how shipping companies structure their charges—how they calculate free time, how they apply demurrage and detention, and where these charges cease to have a legitimate basis.

This operational experience, rare among maritime lawyers, is what underpins his work. It's not about interpreting the charge from the outside: it's about knowing the rules from the inside.

A lawyer since 1994, he holds a Master's degree in International Law from PUC-SP, with specialization from Harvard Law School, an MBA in International Commerce from USP, and a postgrad degree in Legal Compliance from FGV. He is the author of the book "Flags of Convenience". Throughout his career, he has combined technical and legal expertise with data intelligence and the productization of services, developing his own billing audit tools that give clients predictability, cost control, and real contestability.

Areas of focus: Undue Demurrage and Detention, Abusive Charges by Shipping Companies and Terminals, Maritime and Port Litigation, Logistics Cost Auditing.

Founding Partner | Head of Maritime Litigation and Real Estate Law

A lawyer since 2004, Dr. Abilio Scaramuzza Neto brings something rare to the firm: procedural experience in demurrage and detention built from within one of the most traditional maritime law firms in Brazil. For over five years he worked at Kincaid | Mendes Vianna Advogados, where he was responsible for the legal management of the São Paulo office and conducted litigation for maritime and airline companies in all procedural phases — claims, freight charges, container demurrage, and detention.

It was on the side of those who were collecting that he learned how a collection strategy is structured to be unbeatable. This is, today, his advantage when defending those who pay: no one dismantles a collection strategy better than someone who has already constructed it.

A specialist in Environmental Law from PUC-SP, his practice extends to Real Estate, Notarial and Registry Law, and civil litigation in a broad sense — executions, validation of contracts and clauses, judicial and extrajudicial inventories, and environmental administrative defenses. This breadth gives the firm the ability to treat logistical conflict not as an isolated piece, but within the entire chain of contractual, patrimonial, and regulatory relationships that surround it.

He co-founded Scaramuzza & Stein, a firm dedicated exclusively to those who move cargo — freight forwarders, NVOCCs, importers, and exporters.

Areas of focus: Maritime Litigation, Demurrage and Detention, Environmental Law, Real Estate Law, Notarial and Registry Law.
